Digital Communities, Inc. reserves the right to review any Information that is or becomes available on the Service. Digital Communities, Inc. reserves the right to refuse to post or to remove any Information that is, in Digital Communities, Inc.'s sole discretion, unacceptable, undesirable or in violation of these rules. However, Digital Communities, Inc. has no obligation to exercise such reservation of rights by Digital Communities, Inc..

No advice or information provided by the Service shall create a warranty. Digital Communities, Inc. does not warrant that the Service will be uninterrupted or error free. Digital Communities, Inc. does not warrant that the Service will appear as intended due to the various versions of Web browsers used on the Internet. Under no circumstances shall Digital Communities, Inc. be liable for any direct, indirect, incidental, special, punitive or consequential damages that result in any way from your use of or inability to use the Service or to access the Internet or any part thereof, or your reliance on or use of information, services or merchandise provided on or through the Service, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission, or any failure of performance.
6. Failure to Comply With Terms and Conditions. You agree to defend, indemnify and hold Digital Communities, Inc. harmless from any and all liabilities, costs and expenses, including reasonable attorneys' fees, related to any violation of this Agreement by you or users of your account, or in connection with the use of the Service or the Internet or the placement or transmission of any message, information, software or other materials on the Internet by you or users of your account.
7. Miscellaneous. You shall not post offensive language in connection with the use of the Service. You shall not post advertising or commercial self-promotion information in connection with the use of the Service. You shall only use one name/alias in all of your postings to Garden Gazebo. You assume total responsibility and risk for your use of the Service in connection with the posting or inclusion of your E-Mail address, personal data, photographs, and all other information which you may post or provide to Digital Communities, Inc..

Digital Communities, Inc. may modify this Agreement from time to time; and your continued use of the Service following such modification shall be deemed to be your acceptance of any such modification. If you do not agree to any modification of this Agreement, you must stop using the Service.

This Agreement shall be governed by and construed in accordance with the laws of the State of Virginia, without regard to its conflicts of law provisions.

This Agreement constitutes the entire agreement between you and Digital Communities, Inc. with respect to the Service.
